Apostille & Authentication

Taking Your Documents Across Borders

When a document leaves South Africa, it often loses its legal voice. Foreign authorities will not simply accept a South African certificate, affidavit or contract unless it has been formally verified. Apostille and authentication are the methods used to give your document that international recognition.

At Barnard Attorneys Inc., we manage this process from start to finish so you do not have to navigate government departments, embassies and technical rules on your own.

When Do People Need Apostilles or Authentication?

People usually need document legalisation when life or business moves beyond South Africa’s borders. Common examples include:

  • Relocating or applying for visas or residence abroad
  • Enrolling at foreign schools or universities
  • Buying, selling or managing property overseas
  • Doing business in another country
  • Getting married or finalising family matters outside South Africa
  • Using South African court or legal documents internationally

If a foreign authority has asked for your documents to be “legalised,” “apostilled” or “authenticated,” this is what they mean.

Two Different Routes: Apostille or Authentication

Not all countries follow the same system.

Apostille

If your document is going to a country that belongs to the Hague Convention, it can usually be legalised with a single apostille certificate. That certificate confirms that the signature, stamp and capacity of the person who signed your document are genuine.

Authentication

If the destination country is not part of the Hague Convention, the document must go through a longer chain of verification. It is checked by South African authorities first and then by the foreign embassy or consulate. This is called authentication.

Which route applies depends entirely on the country where your document will be used.

Types of Documents we usually Handle

We assist with many kinds of documents, including:

    • Birth, marriage and death certificates
    • Police clearance certificates
    • Academic records and qualifications
    • Powers of attorney
    • Company and business documents
    • Contracts and commercial papers
    • Affidavits and court orders
    • Notarial deeds and declarations

How the Process Works in Practice

Every document and every country is different, but the process usually follows this path:

  1. Checking Your Documents

We first confirm what you have, where it is going, and what that country requires. This step avoids wasted time and rejected applications.

  1. Preparing the Documents

Some documents must be certified, re‑issued, or converted into a notarial format before they can be legalised. We guide and handle this where needed.

  1. Notarial Work (If Required)

Certain documents must be notarised before they can move to the next stage. Our Notary Public deals with this directly.

  1. Legalisation
  • If the country is part of the Hague Convention, we arrange the apostille.
  • If not, we manage the full authentication chain, including embassy or consulate legalisation.
  1. Return of Your Documents

Once complete, your documents are ready to be used abroad and are returned to you.
