Antenuptial Contracts (ANC) is a legal agreement entered into before marriage that determines how your assets and debts will be treated during the marriage and if the marriage ends through divorce or death.

Marriage in Community of Property

If you marry without  Antenuptial Contracts (ANC) you are automatically in community of property.

What this means:

  • One joint estate
  • All assets and debts (before and during the marriage) are shared
  • Each spouse owns an equal half‑share of everything

Key risks:

  • Both spouses are liable for each other’s debts
  • Insolvency of one spouse affects both
  • Managing a joint estate can be complex

Possible advantages:

  • No contract required before marriage
  • Financial protection for the weaker spouse
  • Equal management powers (with certain transactions requiring written consent from both spouses
Marriage Out of Community of Property With Accrual

Requires Antenuptial Contracts (ANC) signed before the wedding.

How it works:

  • Separate estates during the marriage
  • Each spouse manages their own assets and debts
  • On divorce or death, the growth of each estate during the marriage is compared
  • The spouse whose estate grew less may claim half of the difference

Assets owned before marriage must be listed and excluded in the ANC if they are not to form part of the accrual. Inheritances, donations and personal injury damages are generally excluded by law unless stated otherwise.

Advantages:

  • Fair sharing of wealth built during the marriage
  • Protection of pre‑marital assets
  • No liability for each other’s debts
  • One spouse’s insolvency does not affect the other

Disadvantage:

  • The stronger‑earning spouse shares the growth of their estate
